CITRUS by Kunz is registered as a sole proprietorship in Switzerland under CHE-390.795.852 and operates from Rotachstrasse 25, Zürich Switzerland.

 

It is very important to us that our customers are happy with our products (“Products”) and we will always ensure to find a quick and easy solution to any problem that may arise. 

 

The following terms and conditions (“Terms”) apply to all orders that are placed on our website (www.citrusbykunz.ch) (“Website”). However, for your convenience, they also contain some information for purchases that are made in one of our showrooms or in a third-party store.

 

1. HOW TO ORDER OR PURCHASE OUR PRODUCTS

 

Our Products can be ordered on our website or purchased in one of our showrooms or third-party stores in Zurich.

 

2. ONLINE ORDERS

2.1 PLACING AN ORDER ON OUR WEBSITE

 

All Products that can be ordered on the Website are made to order, which means that they are produced specifically for you as soon as your order is placed. By placing an order on our Website, you make an offer to conclude a work contract to which you remain bound for 10 business days. The work contract for production of the Product becomes binding as we send you an order confirmation to you email address.

 

If you have any questions about the Products, please contact us before placing an order. All orders that are placed on the Website are final and cannot be cancelled during the production stage. We therefore ask you to choose carefully. 

 

2.2 TURNAROUND TIMES FOR ORDERS

 

The turnaround time for Products that are ordered on our Website is between eight (8) to ten (10) weeks plus shipping, but can be up to twelve (12) weeks plus shipping if the order is placed during peak sales periods. 

 

2.3 PRICING AND PAYMENT

 

All prices displayed on our Website are in Swiss Francs (CHF) and subject to change without notice. Full payment of the purchase price is required when you place an order for a Product. Please note that we can currently only accept payment by credit card (Visa and Mastercard).

 

Please note that our Website is primarily aimed at the needs of our private customers. For this reason, it is not possible for us to issue subsequent invoices, receipts or VAT invoices for your online order.

 

2.4 SHIPPING AND TRANSFER OF RISK

 

We can ship Products ordered on our Website to any destination address within Switzerland or Liechtenstein. You can see the various shipping options and prices when you place the order. 

 

Please note that we can currently not ship our Products to delivery addresses outside of Switzerland or Liechtenstein. If you have no ordinary place or residence or delivery address in Switzerland or Liechtenstein, we kindly ask you to pick up your Product as described below. 

 

We are not be liable for damage cause or any fault on the part of the transport company used. Our contractual performance is fulfilled with the handing over of the Product to the transport company. After dispatch, the risk of accidental deterioration and accidental loss of the Products passes to you.

 

2.5 PICKING UP PRODUCTS

 

If you would like to pick up the Product yourself or send a courier to have it collected, please let us know in advance so we can agree on a pick-up days and can ensure that it is packed appropriately and ready to go. A packing and handling fee may apply.

 

2.6 WARRANTY

 

We guarantee that our Products are free from technical defects and are suitable for inside and outside use in all weather conditions. Since our Products are hand-made, there will be minor deviations from the Product we make for you and the photos of Product examples that are displayed on the Website. Please note that these deviations do not qualify as technical defects and are not subject to warranty.  

 

If there is a quality issue with a Product, please send us an image and a description of the issue so we can work with you to find the best solution. By placing an order on our website, you agree that the remedying of defects is done at our discretion either by subsequent performance, i.e. elimination of a defect (subsequent improvement) or delivery of a defect-free Product (replacement delivery). Replaced Products become our property and must therefore be returned to us. 

 

2.7 NO RETURNS OR REFUNDS

 

Since the Products purchased on our Website are made to order, we do not take returns or offer a refund in case you change your mind. 

 

3. IN-STORE PURCHASES

 

The current collection of our Products is often times displayed and available for purchase in one of our showrooms or in third-party stores. 

 

If you purchase existing stock at one of these locations, you can exchange it within 14 days of the date of purchase for another Product or request a store credit for a future purchase (no money-back guarantee). To be eligible for a return, your Product must be in the same condition as you received it. All Products that are eligible for a return must be returned in person to the location at which they were purchased.

4. LIMITED LIABILITY

 

All cases of breach of contract and their legal consequences as well as all claims, no matter on what legal grounds they are made, are conclusively regulated in these Terms. Our liability towards you is excluded to the extent legally permissible. We are not liable to any extent for any damages that have not occurred to the goods themselves, in particular not for consequential damages, loss of profit or other financial losses.

5. INTELLECTUAL PROPERTY RIGHTS

 

Our Products are protected under Swiss and international intellectual property law. The reproduction of our Products or the reselling of our Products under any other name than CITRUS by Kunz is strictly prohibited without our explicit approval and is punishable under the Swiss Unfair Competition Act.

 

Your use of this site and its content does not give you any rights in relation to any designs, trademarks, copyright and all other intellectual property and material rights relating to CITRUS by Kunz, the Products and any other items and images on this site. All other third party trademarks, designs, and related intellectual property rights mentioned or displayed on this site are protected by intellectual property laws. 

 

6. MISCELLANEOUS

6.1. NO MODIFICATIONS UNLESS IN WRITING

 

No modification, amendment, supplement to or waiver of these Terms shall be binding unless made in writing and duly signed by both parties.

6.2 SEVERABILITY

If any provision of these Terms should be invalid in any jurisdiction under applicable law, the legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby

6.3 APPLICABLE LAW AND JURISDICTION

 

The terms and any agreements executed on the Website shall be governed by and construed in accordance with Swiss law, excluding the Swiss conflict of law rules. The application of the United Nations Convention for Contracts for the International Sales of Goods is hereby expressly excluded. 

 

Any dispute, controversy or claim arising out of or in connection with these Terms or their breach, termination or invalidity shall be exclusively settled by the courts of Zurich, Switzerland.
